»'The Constitution Is Our Guiding Culture'. Constitutional Theory and Constitutional Law Perspectives on Equating the German Constitution with the concept of 'Leitkultur'«: The very German concept of 'Leitkultur' as a »guiding culture« is often equated in political debate with the German constitution. But what does this actually mean? This study examines the constitutional and theoretical foundations of this claim through the core values of the 'Grundgesetz' and the principle of practical concordance and argues that this claim ultimately expresses a constitutional-theoretical expectation of consensus-oriented resolution of social conflicts.

The author is a research assistant at the Chair of Public Law at the University of Passau. Her doctoral thesis examines the relationship between the German constitution and the concept of »Leitkultur« from the perspectives of constitutional theory and constitutional law. Another of her research focuses lies on railway law.
