»Consumer Damage in the Unfair Competition Act. Requirements and Consequences«: This paper examines the prerequisites for individual consumers' claims for damages, which have existed since May 28, 2022, under Section 9 (2) Sentence 1 of the Unfair Competition Act (UWG), as well as the legal consequences that may arise if these prerequisites are met. It also examines whether the introduction of this section has improved consumer protection within and outside the existing protection system.

Philipp Freuer studied law at Philipps-University in Marburg. After graduating, he worked as a research assistant in the dean's office of the department and, first at the Research Center for Public Administration and then at the German University of Administrative Sciences Speyer. Since January 2025, he has been a legal trainee at the Higher Regional Court of Frankfurt, with his main office at the Regional Court of Darmstadt.
