Liability arises only where disclosure is clearly indefensible due to errors in judgment, calling for a nuanced, case-by-case approach.

Chiara V. Henrich studied law from 2016 to 2022 at the Faculty of Law of Heidelberg University and at Leiden University, Netherlands. Following her First State Examination, she completed her doctorate from 2022 to 2025 at the Chair of Criminal Law, Criminal Procedure Law, Medical Law and Philosophy of Law under the academic supervision of Professor Dr. Jan C. Schuhr. During this time, she worked as a research assistant at the Institute for German, European and International Criminal Law and Criminal Procedure Law at the Chair of Prof. Dr. Frank Meyer, LL.M. (Yale). The author completed her legal clerkship at the Higher Regional Court of Berlin, where she also passed her Second State Examination in 2026.
