It elaborates on the medical and legal foundations and outlines the range of conceivable scenarios. On this basis, the various objections put forward against imputation are analyzed. Finally, possibilities for limiting imputation are examined and brought together in a proposal for an imputation model.

Nick Heinrichs studied law at the Humboldt University in Berlin, with a focus on criminal law. There, after his first state examination, he obtained his doctorate under the supervision of former presiding judge at the Federal Court of Justice, Prof. Dr. Günther M. Sander. Subsequently, he worked as a research assistant in an international law firm in the field of data protection and IT law. He then completed his legal clerkship in the district of the Berlin Court of Appeal from 2022 to 2024.
