»Containment of the Right to Choose a Doctor on the Basis of the Principle of Economic Efficiency«: The right to free choice of doctor is in tension with the economic efficiency requirement of SGB V. This can be attributed in particular to the fact that general practitioners and specialists can predominantly be consulted directly and treating service providers can always be changed. Against this background, the study examines reform options, in particular the introduction of (comprehensive) referral reservations to control access to care.

Nadja Dussel studied law at the Albert-Ludwigs-University Freiburg and the Universidad de Oviedo (Spain) from 2014 to 2020 with a focus on labor and social law. After completing her first state exam, she obtained her doctorate under Prof. Dr. Katharina von Koppenfels-Spies and worked as an academic assistant at the Institute for Commercial Law, Labor and Social Law, Department III: Social Law at the University of Freiburg. She has been a legal trainee at the Hanseatic Higher Regional Court since June 2024.
