»Sustainability Obligations in the Light of Entrepreneurial Freedom«: This analysis begins by examining the conceptual foundations of sustainability and the relevant legal frameworks. It then outlines cross-sector sustainability obligations that companies are increasingly subject to. These obligations are critically assessed against the yardstick of constitutionally protected entrepreneurial freedom rights. The findings indicate that certain regulatory measures adopted under the banner of sustainability may conflict with European Union an constitutional law. The effects of these obligations on companies are analysed on the basis of an empirical survey.

Autorenportrait

Maurice Christian Gatzweiler, LL.M. has been a legal advisor at the Federal Court of Audit since October 2024 and is responsible for the Legal department. Prior to this, he worked for several years as a lawyer for a law firm specialising in tax law, with a focus on succession and non-profit law. He studied at the universities of Bonn, St. Gallen and Düsseldorf, specialising in competition law, intellectual property and medical law. He completed his legal clerkship in the district of the Higher Regional Court of Düsseldorf. Dr Gatzweiler completed his doctorate under Prof. Dr Dr Udo Di Fabio on regulation from a sustainability perspective.
