Normwidrigkeit und Zurechnung bei Sonderdelikten (Felipe Belmar Todorovic)

»Antinormativity and Imputation in Special Offenses. A Norm-Theoretical Investigation of their Foundation, their Consequences for Participation and their Differentiation from the so called Improper Special Offenses«: Actions have different meanings depending on the context and the actor. It is not different with crimes. The legal system places different demands on legal subjects depending on their position. This work examines the expectations attached to special positions and their limits. It is argued that special offenses are to be understood as violations of special norms. On this basis, an interpretation key of 28 StGB is proposed.

Felipe Belmar Todorovic, LL.M. is a Chilean law scholar specializing in criminal law and legal theory. He studied law at the Universidad de Chile, where he graduated summa cum laude. Belmar received his LL.M. and doctoral degrees from the University of Hamburg, also summa cum laude. His areas of research include criminal law, general theory of law, the recognition of non-human animals, and the development of artificial intelligence. In his works, Belmar incorporates insights from analytical philosophy and philosophy of languages, especially from the theory of action and the theory of norms.
