Strafrecht im Metaverse (Tim Erkens)

»Criminal Law in the Metaverse. Applicability of substantive Criminal Law in the future Internet«: The Metaverse, as an immersive development of the Internet of the future, raises new questions for substantive criminal law. This paper addresses these issues in the context of the 94th Conference of German Justice Ministers in 2023. It aims to identify gaps in criminal liability and propose adjustments, also considering brain activity in virtual spaces, artificial intelligence and virtual assets.

Tim Erkens studied law at the Rheinische Friedrich-Wilhelms University of Bonn from 2018 to 2023. During this period, he worked, among other positions, as a research associate at the commercial law firm Flick Gocke Schaumburg. After completing his First State Examination, he pursued a doctorate at the University of Cologne, supported by a doctoral scholarship from the Hans Böckler Foundation. Since September 2025, he has been completing his legal clerkship at the Higher Regional Court Cologne.
