»On the Question of the Applicability of 630e BGB in the Context of Criminal Liability for Medical Informed Consent Errors«: The physician´s duty to inform developed over decades by civil court jurisdiction also apply to criminal law in die sense of limited accessoriness. As a result, this does not mean necessarily a concurrence of civil and criminal liability for medical errors in the form of incorrect or missing information if the procedural and substantive particularities of the different legal systems and thus the principle of a consistent overall legal systems are not to be abandoned.

Sinah Becker studied at the Christian-Albrechts-University of Kiel and completed her legal clerkship in Schleswig-Holstein. Since 2021, she has been working in Hamburg as a lawyer in the field of commercial and corporate law as well as civil procedural law. She represents clients in complex commercial law disputes, in particular in the context of shareholder and liability actions in the healthcare sector, and also advises on company formations, restructuring and corporate law contract drafting.
